Terms and Conditions

General
These Terms and Conditions apply to all transactions between us and you. They do not affect your statutory rights. Please read them carefully.
We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on our website.
These Terms and Conditions are governed by English law and are subject to the non-exclusive jurisdiction of the English courts. We do not accept amendments to these Terms and Conditions.
Failure by us to enforce any of these Terms and Conditions will not affect our right to enforce the rest of these terms and conditions.

Customer Orders
We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.
To order goods on our website, you must be at least 16 years of age and accept delivery within the UK. All orders placed on our website will be acknowledged electronically by email. Please note that electronic acknowledgements do not constitute order confirmation or order acceptance. Your order will be accepted and the creation of a legally binding contract between you and us will take place once the goods have been dispatched or collected. (Alternatively, we may decline all or part of your order for any reason, in which case we will inform you in person, or by telephone or email.)
When deciding whether or not to accept your order, we may use certain information about you, including any received from credit reference agency checks. This helps to protect you and us against fraudulent transactions.
We will tell you if your payment details cannot be authorized for any reason, and may invite you to pay by another method or suggest that you visit our shop.

Prices
The total price payable will be stipulated at the time when you place your order, whether or not the order has been acknowledged. We are entitled to make adjustments to the price to take account of any increase in our suppliers’ prices, or the imposition of any taxes or duties, or (if due to an error or comission) the price published for the goods is wrong, whether or not the order has been acknowledged. We will inform you of the correct price and give you the opportunity to cancel the order. All prices are inclusive of VAT, but exclusive of delivery charges, which will be payable as indicated at the time the order is placed.
Prices, offers and products are subject to availability, and may change before (but not after) we accept your order. If a product becomes unavailable we may offer you an alternative or suggest that you visit our shop.

Delivery Policy
UK STANDARD DELIVERY:
Orders can be placed via our website; this service is open 24 hours a day, 7 days a week.
Delivery is normally within 3-5 working days of receipt of order, subject to availability, although please allow up to 14 days. Out of stock items may take up to 28 days.
Orders received before 1.00pm Monday to Friday are dispatched the same day. It is possible that orders received after this time will also be dispatched on the same day but we are not able to guarantee this.
All orders are sent via Royal Mail's Recorded Delivery Service or Parcel force and are trackable.
Delivery charges for all UK delivery orders:
• Royal Mail first class recorded £2.95
• Royal Mail special next working day £3.99 (delivered before 1pm)

FREE DELIVERY OFFER
You can get free UK* delivery when you spend £30 or more per order, per delivery address in the UK. This offer excludes orders containing gift vouchers, clearance items or multi buy offers.
The free delivery offer is subject to availability and available for deliveries to mainland UK only*.

International Orders
We are happy to ship orders to addresses within the European Union but additional postage will be payable and payment must be made through Paypal. Please choose the relevant options when going through the checkout process; we will then invoice you separately through PayPal with shipping charges. If you would like to check postage charges before ordering please email us.
Please Note that international orders may be subject to additional customs charges and import duties for which we are not responsible.

Security
Credit/ Debit Card Payments: Payment can be made securely using Paypal, you do not need longer to sign up for an account to use it, however if you already have an account the checkout process will be quicker. By using this provider we are ensuring the highest levels of security for you, as this provider does not pass us any of your card information. Feel free to visit Paypal website for further information on its services.

Cheque& Postal Order: You can order online and pay us by Cheque these must be UK Sterling and usually take between 5 – 7 working days to clear. It is recommended you print off your order, at the end of the checkout process, to send with your payment.

Availability
All product information provided on this website is intended as a guide only. Dimensions and weights are approximate, as are colours. If you are ordering goods that are out of stock, we will dispatch them when they are received from our supplier.
Goods are occasionally subject to availability, and delay in delivery of goods is sometimes outside our control. As such, delivery cannot be guaranteed, and any dates we specify for the delivery of the goods are approximate only. We shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay in delivery of the goods.

Returns & Refunds
We hope you will be delighted with your purchase but should you purchase any goods from Mushroom & Co. that you are not entirely satisfied with we will be happy to exchange them for another item or offer you a full refund of the purchase price, less the delivery fee.
Goods purchased through www.mushroomandco.com may be returned by post at the customer’s expense for a full refund within fourteen days of delivery in the original packaging and condition providing that the goods are unused and you have your receipt; with covering letter explaining why you are returning the goods, including your name, address and order number. Return postage is at the customer’s expense.
We recommend you send the goods back to us via Royal Mail Recorded Delivery and regret that we are unable to refund any postage costs incurred unless an item is faulty.
Any goods with manufacturing faults on arrival will be replaced or refunded.

Any refunds due to the customer will be processed within 24 hours of receipt of the goods by Mushroom&Co.

Privacy Policy
We are committed to protecting your privacy and will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).
We collect information about you for two main reasons:
• To process your online order.
• To provide you with the most efficient service possible.

The personal information which we hold will be held securely in accordance with our internal security policy and the law.
We do not pass your personal information on to third parties. All transactions that you initiate with Mushroom & Co. on this website are confidential. Your name will not be added to any third-party mailing lists.
The information collected will be used to personally keep in touch with you, and to let you know of any offers, sales or promotions that Mushroom & Co. are carrying out (if you have selected to receive these emails or newsletters).
We may use technology to track visitors to our store. This can include using a "cookie" which is stored through your browser. Most browsers can be modified to stop this from happening. The information collected in this way can be used to identify you unless you modify your browser settings. Most browsers accept cookies automatically, but usually you can alter the settings of your browser to prevent automatic acceptance. Sizing / Colouring
We have made every effort to accurately display sizes, colours, shapes of our products but they are not guaranteed. Colours and packaging can differ from presented on the website due to changes in design or the visual settings and hardware of your computer.

Cancellation
You have the right to cancel your contract with us from the date the order was placed and up to seven working days after delivery. To exercise your right of cancellation, you must provide us with written notice. You must give details of the goods ordered, and their delivery.

Once you have notified us that you are cancelling the contract, you must return (at your own expense) the goods to us at the above address with the returns note. For your own piece of mind we recommend obtaining proof of posting and adequate insurance for any items returned as we can not accept responsibility for items lost in the post.
Once you have notified us that you are cancelling the contract, we will refund or re-credit you (via your original payment method), as soon as possible but in any event, within 30 days. For any sum that has been paid by you for the goods excluding any extra charges incurred by us at your request (e.g. additional postage options such as signed for or special delivery).
You have a duty of care under these terms, to take care of the goods so that they may be sold again as new. We will claim from you, for the resulting loss in value for goods not kept so that they may be sold again as new.

Cancellation by Us
We reserve the right to cancel your order if:
- We do not have sufficient stock to deliver the goods you have ordered;
- or we are unable to deliver to your area or country;
- or if one or more of the goods you ordered was listed with incorrect information including without limit price, and/or description for whatever reason;
- You use a discount code which you are not entitled to use.

Events beyond our control
We shall have no liability to you for failure to deliver goods, any delay in doing so, for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs, terrorism and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
